rod must be on my property?

nearest patch of dirt is on the neighbor property

question never came up fir me before

the only reason why not?
his future upgrade could use my rod
or he could snip it, not under my control

Most building/zoning codes have a maximum allowed impermeable coverage for a given lot. Don't know how you wound up with 100% cover. All I can suggest is core drill to dirt and drive a rod. Or more likely, two.

lots of apartment buildings in urban areas have no dirt showing.

Acorn? Some AHJs want the acorn below grade.
some AHJ's are kind of needy.

If only 8 foot rod then the connection would need to be below grade. If longer and 8 feet of rod is below grade the connection can be above grade. Some situations may need additional physical protection.
