Proper disconnection of 3 phase motor circuit

I was under a machine at work a couple days ago looking for a wiring route for some new I/o's to a plc when I seen a taped up cable hanging down touching the ground. I followed it back to a 3 phase c/b that was turned on. If I had taken a motor off of a machine I would have disconnected the c/b of this unused circuit and taken the wiring out. I believe someone could have seriously been hurt either by a cross phase explosion or an electrocution. Is it proper by code to leave a taped up hot 3 phase cable hanging out of a machine to the ground like this?

His first proposal was to force removal, but now he's looking at tagging these potential hazards.

I'm for the removal option but I don't know how to write the code to prevent it from being Draconian.
