Cat 5 cabling

I'm a network specialist and one of my sites was pre cabled with Cat5 by the contractor. In 4 of the runs the cat 5 cable was coming out of the wall literally through a hole along with the electrical cable in flex conduit. No receptacle, no separate raceway. The cat 5 also ran through the wall adjacent to the flex conduit, again no raceway of any sort.

I say it's illegal to do so?? If so I need the code to that effect.

It's fine, done it myself. There is nothing in the code to prohibit this, there is no separation requirement in this case nor would there need to be. See 800.52(2) exception #1

Your computers will work just fine, rest easy.

As long as the power circuit was in raceway (conduit), it is not a code violation. It may violate a specification or contract requirement made by the design engineer, in which that would be contractual issue not code.

If your question was that the Cat 5 was not in raceway itself, there is no code requirement for all cat 5 to be in raceway. Review the sections of the code mentioned above and that will help you understand the requirements. If not, you need to explain the question in more detail.
