Wiring located in a return air duct .. legal ?

I need a fast answer !!!! I know wiring located in a return air is not acceptable .. but I am almost positive there is an exception as log as the wire travels horizontal to the return. AM I dreaming on this ???

300.22(C)Exception: This section shall not apply to the joist or stud spaces of dwelling units where the wiring passes through such spaces perpendicular to the long dimension of such spaces.

This will not apply to a metal duct.
