Have a charger thats rated 48A @240V

Mfgrs install states 60A CB or 60 fuse. Cu conductors.

I thought I recalled a thread here that said #6 Cu NM cable was non code compliant.

55A. Next size standard OCPD 60 A. Not supplying multioutlet receptacle branch circuits.

You need a 60 amp conductor. If you want to use NM you need to use #4. You can install #6 in a raceway or use #6 MC cable.

48 amps but it is considered a continuous load so 48 x 1.25 = 60 amps therefore you need a conductor for 60 amps as stated above

The "glitch" occurs due to wording of Art 625.41 requiring the circuit to be sized as a continuous load so your 48A becomes 60, and 210.19 which requires the conductor to be sized no smaller than the load, and 334.80 which requires NM to be installed at its's 60°C rating.
#6 Cu SE cable would also be suitable if you are on the '17 or later NEC.
