The general rule in the building code (Section 704.2.4-1997 UBC here) is that pipes and conduits cannot be embedded in the required fire protection of structural members. As long as the required thickness was maintained between the EMT and the structural member, it would seem to meet the intent of the code.
Is there something in the NEC that would prohibit fireproofing on the EMT?
