NJ Rehab Code ?

As the AHJ is generally unavailable until after 3PM, I figured I ask here:

I have a panelboard to swap out in a church. The room the existing panelboard is located in also houses 2 oil fired boilers. The clearances from the panelboard fronts to the boilers/pad does not exactly meet the req.'s for clearances (110.26) by at least a few inches (not feet).
The existing arrangement contains:
200A 1? FPE Fused disconnect
4x4x30 raceway/gutter/throught, connected to this is:
1 - 30A 1? Disconnect (fused, Murray)
1 - 50A 1? Disconnect (CB, FPE)
1 - 100A 1? MCB Square D (horizontially mounted)

I propose to remove all the equipment EXCEPT for the 200A fused disconnect and install a 200A SD QO MCB panel (vertically) and connect all loads into same eliminating the disconnects and horizontial panel.

The question:
Does the proposed work fall inline with the applicable articles of the NJ rehab code, which states in part:

Existing electrical wiring and equipment undergoing repair or replacement shall be allowed to be replaced with like material except for the following: (Electrical)

i. Replacement of electrical receptacles...;

ii. Plug fuses of the Edison-base type shall be used only for replacements ..;

iii. For replacement of nongrounding-type receptacles ..;

iv. Non-"hospital grade" receptacles.. and

v. Frames of electric ranges..

...just spoke to AHJ...installation IS covered under Rehab code.


NJ EC's take note...the Rehab Code is a tool for you to use and make money with...while saving your customers money, too.
