3-pole breaker being used for a 2-pole application

Does the NEC allow for a 3-pole breaker to be used to supply power to a 208V single phase circuit. I'm asking this because I have a 208V 3-pole 50A breaker that currently supplies an equipment being replaced. The new equipment only needs a 208V 50A 2-pole breaker. The breaker's in this panel are hard to find, so that is why I'm asking the question. Thanks

Yes you can use a multi-pole circuit breaker for single pole applications.

Nope, no NEC violations. Might waste some slots in the panel but that's your prerogative if you so choose.
