Installing a Service Rated ATS Without rthe Generator

I recently installed a 600A 120/240 3W Sinlge Phase service rated ATS ( as my main service disconnect) for a planned generator. The owner has decided to hold off on the generator install for sometime in the future. However, the electrical inspector is telling me that the ATS cannot be installed without the generator, even though it is service rated. Is he correct?

Assuming the reason for the ATS is for a future Art 702 optional system he is wrong. This would be no different than a spare branch or feeder breaker, spare raceways, etc. that are not used.

I agree. I personally worked on (ATS startup) a new house ($40M) for one of the partners of Google in Palo Alto, CA that had a service entrance rated ATS feeding the bldg with no permanent generator installed.....just a Tap Box for a portable hook up.
But then again with that much horsepower maybe he paid off the city to bypass any local codes or AHJ's...ha!
(my theory on this......he had the whole house backed up by UPS so there was no need for immediate generator power till the portable was connected.) OR, since it was a residential area it may have been a noise ordinance issue.

I can't think of a violation that's created by planning for the future. You would need a code section to know exactly what the inspector's is thinking.

I ran into the same thing with a ATS with out the generator. The only thing the inspectors ASK for was a label on the ATS stating minimum size 22Kw - maximum size 40Kw generator.

How about the inspector cannot tell whether the installation will eventually be compliant when a generator is installed since he cannot know the specifications of the generator? Since it is an ATS, load shedding might be needed!
----A really stupid and weak argument, but who knows?----

There will be a permit and inspection when the genset is installed
