I seem to remeber the NEC relaxed conduit fill requirements when reusing existing conduit. I cannot seems to locate the requiremenst in the 2008 NEC edition.

Why would they do that? The size of the raceway has not changed and neither has the conductors. (outside of any deterioration that may have occurred since original install)

The new versus existing fill rules go way back, I'm thinking in the 1960's. I have a vague recollection that I read this in the basement shop of my father's house when I was a teenager.

Many years ago there was a 25% fill limit for new work and 40% limit for re-work. I am not sure when that was changed to just 40% for all applications. It was before I started in 73, but how much before, I don't know.
