I have a problem with everything. ;)

240.33 Vertical Position. Enclosures for overcurrent devices
shall be mounted in a vertical position unless that is
shown to be impracticable. Circuit breaker enclosures shall be
permitted to be installed horizontally where the circuit breaker
is installed in accordance with 240.81. Listed busway plug-in
units shall be permitted to be mounted in orientations corresponding
to the busway mounting position.

240.81 Indicating. Circuit breakers shall clearly indicate
whether they are in the open ?off? or closed ?on? position.
Where circuit breaker handles are operated vertically
rather than rotationally or horizontally, the ?up? position of
the handle shall be the ?on? position.

it doesn't seem like either of these references pertain to the issue.

circuit breaker operates horizontally.

the panel is mounted upside down not sideways.

It's NOT upside down, if the main is mounted horizontally. You can mount it for either top feed or bottom feed.

Either way, it would be a compliant installation.

Get it out of your mind that the main always has to be at the "top" of the panel. I hate it when guys who have that line of thinking mount a horizontal main at the top, instead of the bottom, and then run all that unfused cable around the inside of the enclosure.

What problem would you be talking about? Most panels say they can be mounted either way. If the main breaker operates horizontally you are good to go.

I had an inspector tell me one time that as long as the breaker didn't say "no" you were good!:p

Mike for a panel with a main breaker that has the handle so that up is on I can agree with you as does the NEC, as in this photo of the original panel I removed at a house:

But most all breaker panels where all breakers are sideways switching including the main the NEC and UL clearly allows and even the manufactures have emboss printing in both directions as in this panel that I replaced the above panel with:

If you zoom in on the above photo you will see the word "LINE" embossed in both directions just below the main.

If directed at me I have no problem with a 'upside down' panel.
