House Panel Requirement

A homeowner has bought a duplex. In the process of explaining his loads to me so that I could advise him on his service sizes, he shared that he will have one 9kW heat pump hybrid water heater (I am unfamiliar with this unit) for the two units. I told him that as far as I was aware he would be required to have a house panel to serve this "common"load. He has already installed a twin meter bank for two 100 amp panels and done his PEX lines with common hot water to the units. Hewas disappointed at the idea of needing to segregate this plumbing to achieve a separation, avoiding the house panel question. He intends to pay the entire bill (both addresses) so he did not feel there was an issue, though upon discussion, realized the resale implications.
Strictly regarding code, does he have a way around a house panel (and additional meter base to overhead service) if the water heater serves both units? No other common loads.

With his set up he must deal with 210.25. He may be able to back up and install a single meter to supply the entire building 230.40 exception #4. It would then be up to him how he would split the power bill.
